Eldorado Resorts, Inc. and its subsidiaries and affiliates (referred to in this Privacy Policy as “Eldorado” “us,” “we,” and/or “our”) value you as a customer and take your personal privacy seriously. In the course of providing you with products and services, we may collect certain information from or about you. We are providing this Privacy Policy to explain our practices and policies for collecting, using and sharing information collected from or about you when you visit, access, or use, or provide information to us in connection with, one of the Eldorado Properties, Eldorado Websites or Eldorado Mobile Apps, as each term is defined below in Section 1 (referred to together as the “Eldorado Services”). By visiting, accessing, or using, or providing information to us in connection with the Eldorado Services, you expressly consent to our collection, storage, use and sharing of your information as described in this Privacy Policy. Please note that if you disagree with anything in this Privacy Policy, you should not visit, access, or use, or provide information to us in connection with the Eldorado Services.

1. DEFINED TERMS

As used in this Privacy Policy:


(a) “Eldorado Property(ies)” refers to the casino and casino hotel properties located in the United States that are owned, operated or managed by Eldorado. (A current list of Eldorado Properties is available at www.eldoradoresorts.com/properties

(b) “Eldorado Websites” refers to websites owned or operated by Eldorado that display this Privacy Policy, including, but not limited to, www.eldoradoresorts.com.

(c) “Eldorado Mobile Apps” refers to mobile applications owned or operated by Eldorado that display this Privacy Policy, including, but not limited to, the TropAdvantage ® mobile application.

(d) “Personal information” refers to any information by which you can be personally identified, such as your first name, last name, address, phone number, email address, credit card number, social security number, driver license number, passport number, license plate number, geolocation information, loyalty club account number, date of birth, purchase information, gaming activity information, biometric information and other similar information.

(e) “Non-personal information” refers to information by which you cannot be personally identified.

2. INFORMATION WE MAY COLLECT.

We collect and use information we believe is necessary to administer and promote our business and provide you with the products and services you request. We may collect and maintain both personal information and non-personal information needed for these purposes. Your personal information and/or non-personal information will be referred as your “information” in this Privacy Policy.

3. HOW WE COLLECT YOUR INFORMATION.

A. Information You Directly Provide to Us.

You may provide information directly to us under a wide range of circumstances, such as when you submit information to us through the Eldorado Websites or Eldorado Mobile Apps, use any gaming or non-gaming services at an Eldorado Property, are videotaped or photographed in connection with a security incident or for other surveillance purposes, sign up to receive email or text messages from us, sign up to access Wi-Fi at an Eldorado Property, park at an Eldorado Property, install or use one of the Eldorado Mobile Apps, sign up for any of our loyalty clubs, log in as a loyalty club member, book a reservation for an Eldorado Property, enter an online promotion, request information from us, scan your ID at check-in kiosk at an Eldorado property, apply for casino credit or provide feedback in a survey.

B. Information Automatically Collected Through the Eldorado Websites.

           (i) Traffic Data. We automatically track and collect general log information when you visit the Eldorado Websites, including your: (A) Internet Protocol (IP) address, (B) domain server, (C) operating system, and (D) type of Web browser as well as the pages you visit on the Eldorado Websites (collectively “Traffic Data“). Traffic Data does not personally identify you, however, if you choose to provide us with personal information, we may store some items of your personal information and use it with the Traffic Data to better personalize your experience on the Eldorado Websites. We use the Traffic Data to report aggregated website activity and to better understand the needs of our users so we can make informed decisions regarding the content and design of the Eldorado Websites. It enables us to do the following:

  • estimate our audience size and usage pattern;
  • learn what information is of most and least interest;
  • speed up your searches; and
  • learn of any possible Eldorado Website performance problems.


We, or our service providers, may also use Traffic Data to identify your physical location to confirm that you are in a jurisdiction where you can use our mobile or online gaming services. We may collect Traffic Data through various technologies including, but not limited to, cookies, IP addresses, and transparent GIFs (Graphics Interchange Format, a software technology also known as a pixel tag).

          (ii) Data Collected Using Cookies and Other Technologies. We also automatically collect information from you using cookies and other technologies on the Eldorado Websites. Cookies are small text files offered to your computer by servers in order to keep track of your browser as you navigate the Eldorado Websites. Cookies may be stored on your hard drive in which case they remain on your hard drive until deleted, or in temporary memory in which case they are deleted when you shut down your browser or turn off your computer. We may use cookies and similar technologies to identify who you are and may use them when you visit the Eldorado Websites, click on our ads, or open our emails. Cookies also enable us to remember your user preferences for the Eldorado Websites. Cookies and other technologies may also be used for site maintenance and analysis, performing network communications, authenticating users, serving contextual advertisements, and protecting against fraud and theft. You can block or remove cookies using your Internet browser’s settings. If you block or remove cookies, your ability to perform certain transactions, use certain functionality, and access certain content on the Eldorado Websites may be affected.         (iii) Information Collected by Third Parties through Third Party Links and Content. The Eldorado Websites and Eldorado Mobile Apps may include links to other websites and other content from third party businesses. These third party businesses may use cookies, web beacons or other similar technology to collect information about you. Eldorado does not have access to or control over these third parties or the cookies, web beacons or other technology that these third parties may use. We are not responsible for the privacy practices of these third parties or the content on any third party website. You are encouraged to review the privacy policies of the different websites you visit and of the advertisers whose ads you may choose to click on while on the Eldorado Websites (see Section 7 below for additional information about Online Advertising).

            (iv) Information Collected by Third Party Analytics Services. We may work with third party analytics services to help us understand how the Eldorado Properties, Eldorado Websites or Eldorado Mobile Apps are being used, such as tracking the frequency and duration of use of the Eldorado Websites or Eldorado Mobile Apps. These analytics services may use cookies and other technologies to collect information about the content you view, what websites you visit immediately prior to and after visiting the Eldorado Websites, and your system information and geographic information. The information generated by these technologies about your use of the Eldorado Websites or Eldorado Mobile Apps will be transmitted to and stored by the applicable analytics services. The information collected by these analytics services allows us to analyze your use of the Eldorado Websites or Eldorado Mobile Apps.

            (v) Information You Share on Third Party Websites or through Social Media Services. The Eldorado Websites may include links to third party websites and social media services where you will be able to post comments, stories, reviews or other information. Your use of these third party websites and social media services may result in the collection or sharing of information about you by these third party websites and social media services. We encourage you to review the privacy policies and settings on the third party websites and social media services with which you interact to make sure you understand the information that may be collected, used, and shared by those third party websites and social media services. We may also monitor sentiments regarding Eldorado that you publicly post on social media services or customer review sites. We may reach out to you regarding these postings to address customer service issues and to otherwise help ensure that you have a positive customer experience.

C. Information Obtained from Other Sources, including from Service Providers, Third Party Services and Third Party Business Partners.

We may obtain information about you from other sources, including service providers, third party services (such as data brokers or analytics firms), publicly available sources and government agencies and we may combine such information with information we have collected about you as described in this Privacy Policy. To the extent we combine such third party information with other personal information we have collected, we will treat the combined information as personal information under this Privacy Policy. We are not responsible for the accuracy of any information provided by third parties or third party policies or practices.

D. Information We Automatically Collect Through the Eldorado Mobile Apps, including Location Information.

If you install or use one of the Eldorado Mobile Apps, we may collect and use information regarding your mobile device, including but not limited to technical information about your mobile device, system and application software, and peripherals, that is gathered periodically to facilitate any upgrades, product support and other services to you (if any) related to the Eldorado Mobile Apps, and to provide services or technologies to you. In addition, if you install one of the Eldorado Mobile Apps and allow your device to share location information with our Mobile App, we may be able to automatically identify and collect the location of your mobile device, including GPS location, which is the real-time geographic location of your mobile device. We may use your location information for any of the reasons disclosed in this Privacy Policy, including, for example, to provide you with more relevant content and useful app features, such as wayfinding services at Eldorado Properties, or to confirm that you are located in a jurisdiction where you can use our mobile gaming services. We may also use this data for statistical or business-related purposes to improve our products, services and properties. If you allow an Eldorado Mobile App to send you push notifications, your location information may be used to send real-time offers for goods and services at Eldorado Properties that are close to your location. You may adjust your device settings to turn off push notifications at any time. Location information may also be collected and used to tailor your marketing offers to your specific interests. You may choose not to share your location details with us by adjusting or turning off your mobile device’s location services settings; however, by doing so, you may not be able to use certain features provided through the Eldorado Mobile App. Please note that even if you adjust the settings in your mobile device to turn off location sharing (via GPS data), we may be able to collect information about the location of your mobile device if you are located on one of the Eldorado Properties through your Wi-Fi, Bluetooth, and other device settings. See subsection F below for more information.

E. Information We Automatically Collect When You Use Our Wi-Fi Services.

If you use Wi-Fi services that we make available at an Eldorado Property, we might collect information about your use of our Wi-Fi services, including your IP address, Wi-Fi information (such as SSID), mobile carrier, the websites you visit, the type of device and browser you are using, your device identification number, bandwidth used and session time. See subsection F below for more information regarding the collection of information regarding your physical location if you are located on one of the Eldorado Properties.

F. Information We Automatically Collect from Mobile Devices on Eldorado Properties.

If you have a mobile device, are located on an Eldorado Property and have your Wi-Fi or Bluetooth functionality enabled, we may collect information concerning your mobile device, including the type of device, device ID, and the precise physical location of your device within and around the Eldorado Properties (including geolocation and beacon-based location), for analytics and non-marketing related purposes, such as enabling us to understand our customers’ preferences and use of our properties, including general traffic patterns. With your consent, we might also use your location information for marketing purposes, such as to provide you with real-time offers and personalized promotions. If you do not want information concerning your precise location to be collected on Eldorado Properties, you may adjust your mobile device location sharing settings and disable the Wi-Fi and Bluetooth functionality in your mobile device settings.

G. Other Information We Collect Related to Your Gaming and Purchase History with Us.

When you use any of our gaming services or make a purchase at any of the Eldorado Properties, we may collect transactional information about these activities and store it with your customer account. We may use this information to determine your loyalty club tier level (if you are a member in one of our loyalty clubs) and to make predictions about your preferences, and interests, future spending and gaming activity.

 

4. HOW WE MAY USE YOUR INFORMATION.

We will use the information you provide to us for the specific purposes for which you provided the information, as stated at the time of collection, and as otherwise described in the Privacy Policy or permitted by law. The following are some other ways in which we may use your information to administer or promote our business and provide you with the products and services you request or may be of interest to you:

  • to operate one of our loyalty club programs;
  • to improve the products and services we provide you and develop new products and services;
  • to improve the Eldorado Properties, Eldorado Websites and Eldorado Mobile Apps;
  • to track your use of the Eldorado Properties, Eldorado Websites and Eldorado Mobile Apps for our internal market research and analytics;
  • to create a more accurate and complete customer profile for you to better understand and predict the products and services you want to use;
  • to notify you about promotions and special offers regarding products and services provided by us or our affiliates or other associated third parties, including our Third Party Business Partners (defined below);
  • to ask for your participation in our internal market research;
  • to generate aggregate statistical studies about our customers;
  • to contact you in response to your inquiries, comments and suggestions;
  • to provide a secure and safe environment for our guests or employees;
  • to protect and defend our rights or property or enforce our agreements with you;
  • to perform background checks for any reason (to the extent permitted by applicable laws), which includes but is not limited to any investigation into your identity, any credit checks or any inquiries into your personal history
  • to cash your checks, extend you credit, process credit card, ACH and/or other financial transactions;
  • to contact you otherwise when necessary; and
  • otherwise with your consent or as permitted or required by law.

5. HOW WE SHARE YOUR INFORMATION WITH OUR AFFILIATES.

For business purposes, we may share certain information we receive from you, and about your transactions with us, with our affiliates, including our owned, operated, and managed casinos and casino hotel properties, online and web-based businesses, and other corporate entities or affiliates. Doing so allows us to provide the products and services you have requested and quickly respond to applications for credit or other services.

6. HOW WE SHARE YOUR INFORMATION WITH NON-AFFILIATED THIRD PARTIES.

As permitted by law, we may share the information we collect from and about you with non-affiliated third parties as follows:

A. Third Party Service Providers.

Your information may be shared with or collected by third party service providers who provide us with services, including but not limited to data hosting or processing, operation of certain platforms or applications on our behalf, digital advertising, credit card processing, credit or background checks, or processing and fulfilling reservations or purchases. We require these providers to exercise reasonable care to protect your personal information and restrict the use of your personal information to the purposes for which it was provided to them.

B. Third Party Business Partners.

We may share certain information about you with other companies with whom we have a contractual relationship in connection with providing you benefits to which you may be entitled under one of our loyalty club programs. These businesses generally include cruise lines, hotels, and other businesses which may provide goods or services to you as part of the benefits you receive under one of our loyalty club programs. If you qualify for any of these benefits under one of our loyalty club programs, certain information about you may be shared with these Third Party Business Partners. We require our Third Party Business Partners to exercise reasonable care to protect your personal information and restrict the use of your personal information to the purposes for which it was provided to them.

C. Business Transfers; Bankruptcy.

In the event of a merger, acquisition, bankruptcy or other sale of all or a portion of our assets (for example, a sale of one of the Eldorado Properties to a third party), we may transfer or allow third parties to use information owned or controlled by us. We reserve the right, in connection with these types of transactions, to transfer or assign your information and other information we have collected from our customers to third parties or to authorize third parties to use any such information retained by us. Other than to the extent ordered by a bankruptcy or other court, the use and disclosure of all transferred user information will be subject to this Privacy Policy. However, any information you submit or that is collected after this type of business transfer may be subject to a new privacy policy adopted by the successor entity.

D. Response to Subpoenas or Court Orders or to Protect Rights and to Comply with Our Policies.

To the extent permitted by law, we will disclose your information to government authorities or third parties: (i) if required to do so by law, or in response to a subpoena or court order, search warrant or other valid legal process, (ii) to comply with legal, regulatory or administrative requirements of any governmental authorities, including but not limited to gaming regulators, (iii) in connection with any legal action, claim or dispute, including but not limited to the collection of debts, (iv) we believe, in our sole discretion, that disclosure is reasonably necessary to protect against fraud, to protect the property or other rights of us or other users, third parties or the public at large, or (v) we believe that you have abused an Eldorado Website or Eldorado Mobile App by using it to attack other systems or to gain unauthorized access to any other system, to engage in spamming or otherwise to violate applicable laws. You should be aware that, following disclosure to any third party, your information may be accessible by others to the extent permitted or required by applicable law.

E. Aggregate Information.

We may share your information with affiliated or non-affiliated third parties on an anonymous, aggregate basis. While this information will not identify you personally, in some instances these third parties may be able to combine this aggregate information with other data they have about you, or that they receive from third parties, in a manner that allows them to identify you personally.

 

7. ONLINE ADVERTISING; TRACKING.

A. Online Advertising.

Eldorado and third parties may use the information collected through the Eldorado Websites using cookies, web beacons, and other similar technologies to help manage online advertising programs. This information may enable advertising services to track the actions of users online over time and across different web sites or platforms to measure statistics relating to marketing efforts, and to deliver electronic advertisements that may be more relevant to individual consumers and that will improve the consumer experience. B. Do Not Track.

Your browser may allow you to adjust your browser settings so that “do not track” requests are sent to the websites that you visit. However, at the present time we do not disable tracking technology that may be active on the Eldorado Websites in response to any “do not track” requests that we receive from your browser.

 

8. YOUR CALIFORNIA PRIVACY RIGHTS.

A. Shine the Light Law.

This section only applies to customers who are residents of California under California Civil Code Section 1798.83, also known as the "Shine the Light" law, which provides California residents with the right to request information from us regarding the manner in which we share certain categories of personal information with third parties for their direct marketing purposes. Under California law, you have the right to send us a request to receive the following information:

  • The categories of information we disclosed to third parties for their direct marketing purposes during the preceding calendar year;
  • the names and addresses of the third parties that received the information; and
  • if the nature of the third party's business cannot be determined from their name, examples of the products or services marketed.

This information may be provided in a standardized format that is not specific to you. You may make such a request by completing the online form.

 

B. California Consumer Privacy Act.

This section only applies to customers who are residents of California under the California Consumer Privacy Act of 2018 ("CCPA") and other California privacy laws (together "California Laws).

        i. INFORMATION WE COLLECT, WHY WE COLLECT IT AND WITH WHOM WE SHARE YOUR INFORMATION

            We collect information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household or device. For purposes of this section only, this information is referred to as "Personal Information" and falls within the following categories:

Genetic, physiological, behavioral, and biological characteristics, or activity patterns used to extract a template or other identifier or identifying information, such as fingerprints, faceprints, and voiceprints, iris or retina scans, keystroke, gait, or other physical patterns, and sleep, health, or exercise data.

Internet or other similar network activity

Browsing history, search history, information on a consumer’s interaction with a website, application, or advertisement.

Geolocation data.

Physical location or movements.

Professional or employment-related information

Current or past job history or performance evaluations.

Non-public education information (per the Family Education Rights and Privacy Act (20 U.S.C. Section 1232g, 34 C.F.R. Part 99)

Education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information or student disciplinary records.

Inferences drawn from other Personal Information 

Profile reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

 

Personal Information does not include:

  • Publicly available information from government records.
  • Deidentified or aggregated consumer information.
  • Information outside CCPA's scope, such as:
    • health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data; or
    • personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA), the California Financial Information Privacy Act (FIPA) and the Driver's Privacy Protection Act of 1994.

Section 3 above at subsections A through G sets forth the specific information we collect and the sources from which we obtain that information. For each subsection, the below table identifies the categories of Personal Information collected, the purposes for which such Personal Information is collected, the types of third parties with whom we may share the Personal Information and whether such Personal Information has been disclosed during the past 12 months.

        ii. USE AND SHARING OF PERSONAL INFORMATION FOR BUSINESS PURPOSES

In addition to the specific uses and disclosure of Personal Information described in this Privacy Policy, we may also use or disclose your Personal Information for one or more general business purposes as described in the CCPA, which are:

  • To fulfill or meet the reason you provided the information. For example, if you share your name and contact information to ask a question about the Eldorado Services, we will use that Personal Information to respond to your inquiry. If you provide your Personal Information to purchase a product or service, we will use that information to process your payment and facilitate delivery.
  • To provide, support, personalize and develop the Eldorado Websites, products, and services.
  • To create, maintain, customize, and secure your account with us.
  • To process your requests, purchases, transactions and payments, and prevent transactional fraud.
  • To provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses.
  • To personalize your experience and to deliver content and product and service offerings relevant to your interests, including targeted offers and ads through the Eldorado Websites, third party sites and via e-mail or text message (with your consent, where required by law).
  • To help maintain the safety, security and integrity of the Eldorado Services, products, and other services, databases, and other technology assets and our business.
  • For testing, research, analysis, and product development, including to develop and improve the Eldorado Services.

        iii. CALIFORNIA RESIDENT’S RIGHTS.

Under California Laws, California consumers have the right to opt-out of having their Personal Information sold. For purposes of California Laws, the definition of “sale” includes sharing of Personal Information with a third party in exchange for anything of value (money or otherwise). We do not sell the Personal Information of California residents to any third parties.

Under California Laws, California residents also have the rights set forth below relating to disclosure and access and deletion of their Personal Information. (collectively, “Rights”). These Rights are not absolute and are subject to certain exceptions. For instance, we cannot disclose or permit access to specific pieces of Personal Information if the disclosure or access would present a certain level of risk to the security of the Personal Information, your account with us or the security of the business’s systems or networks.

Non-Discrimination: Please note that California residents have a right not to be discriminated against for the exercise of their Rights. Accordingly, unless permitted by the CCPA, if you exercise any of your rights under the CCPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

 

VERIFICATION AND RECORD-KEEPING

If you are a California resident, we will process your request to exercise your Rights in accordance with California Laws. Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your Personal Information.

You must describe your request with sufficient detail that allows us to properly understand, evaluate and respond to it. When a request is made, we will first take steps to verify your identity to protect your privacy and security. Further, if you designate an authorized agent to make a request on your behalf, you may have to submit information confirming such designation. Subject to California Laws, we will not act upon a request until your identity has been sufficiently verified.

We will only use Personal Information provided in a verifiable consumer request to verify your identity or authority to make the request. A record concerning the requests may be maintained pursuant to our legal obligations. Further, do not charge a fee to process or respond to your request unless it is excessive, repetitive or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

We attempt to respond to a verifiable consumer request within 45 days after we receive it. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing within 45 days after we receive your initial request.

Any information we provide in connection with a disclosure or access request will only cover the 12-month period prior to the date we receive your request. The response we provide will also provide the reasons we cannot comply with a request, if applicable.

 

DISCLOSURE AND ACCESS REQUESTS

California consumers have the right to request that we disclose to them, for the 12-month period preceding the date of the request, (i) the categories of Personal Information we have collected about them, (ii) the categories of sources from which Personal Information is collected, (iii) the business or commercial purpose for the information collection, (iv) the categories of third parties with whom we have shared Personal Information, and (v) the specific pieces of Personal Information we hold about an individual. Please note that we are only required to fulfill Disclosure and Access requests from a consumer twice per every 12-month period.

California consumers can make a Disclosure and Access request, subject to the exceptions in the CCPA, by completing the online form or calling Eldorado Resorts at 800-879-8879.

DELETION REQUESTS

California consumers have the right to have their Personal Information deleted, subject to certain exceptions (for example, to comply with legal obligations, complete transactions or for our certain internal uses). Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our services providers to:

  • Complete the transaction for which we collected the personal information, provide a good or service you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.


California residents can make a Personal Information deletion request, subject to the exceptions in the CCPA, by completing the online form or calling Eldorado Resorts at 1-800-879-8879.

 

9. SECURITY.

We maintain physical, electronic and organizational safeguards that reasonably and appropriately protect against the loss, misuse and alteration of the information under our control. With regard to information that you transfer to us through one of the Eldorado Websites or Eldorado Mobile Apps, please be aware that no data transmission over the Internet or a wireless network can be guaranteed to be 100% secure. As a result, Eldorado cannot guarantee or warrant the security of any information you transmit on or through the Eldorado Websites or Eldorado Mobile Apps and you do so at your own risk.

10. HOW TO ACCESS, UPDATE AND CORRECT PERSONAL INFORMATION.

In order to ensure that all of your personal information is correct and up to date, please visit your local Eldorado Property and speak to a customer service representative at one of our promotions booths. You may also change or update information submitted in the past by contacting us in writing at the below mailing address.

11. YOUR CHOICES AND METHODS OF OPTING OUT OF COMMUNICATION FROM US

A. Consent for Mailing

By signing-up to receive emails from us you are expressly providing us with your direct, individual permission to collect and store your email address and to send you periodic electronic messages. You may revoke this consent at any time by following any of the below methods and we will remove you from all of our mailing lists:

  • ONLINE: Simply fill out the online privacy management form and select which properties you do not wish to receive communications from and what types of communications you longer wish to receive.
  • TELEPHONE: Please call us at 1-800-879-8879 and ask for the Direct Marketing Department where our staff will remove you from our mailing list.
  • MAIL: Send us a request in writing at the address listed below.

B. Opting Out of Promotional E-Mails

You may opt out of receiving promotional emails from us by following the instructions in those emails, which directs you to simply click the "unsubscribe" link or button found on the bottom of the email communications. If you opt out, we may still send you non-promotional emails, such as emails about your accounts or our ongoing business relations.

You may also unsubscribe from promotional emails by:

If you no longer wish to receive promotional materials by direct mail from us you may request us to remove you from our direct mailing list by any of the following methods:

  • ONLINE: Completing the online removal request form
  • TELEPHONE: Calling your local Eldorado Property
  • MAIL: Send us a request in writing at the address listed below.

Upon your request, your name and address will be removed from our mailing list. However, you may still receive any promotional materials which were mailed previous to your request.

D. Telephone Calls and Text Messages

You may choose whether you provide your telephone number to receive text messages or advertising telephone calls from us or our agents that are made using an automatic telephone dialing system or an artificial or prerecorded voice. By providing your telephone number and express consent, you are choosing to receive such messages until you withdraw your consent. Your consent to receive text messages or pre-recorded calls using an automatic telephone dialing system is not required to make a purchase or use any of our Services. You may revoke your consent at any time.

If you have provided us with your prior express written consent to receive communications via text messaging (which you understand may include the use of an automatic telephone dialing system (auto-dialer)), you may opt out from future text messages by texting STOP. Once you cancel, we will send one additional confirmation message stating that you've opted out.

12. LEGAL GAMING AGE POLICY.

Persons under the age of twenty-one (21) are not permitted to loiter or gamble at any casino at an Eldorado Property or gamble online or through any Eldorado Website or Eldorado Mobile App. Any offers we make or any promotions we conduct, unless otherwise noted, are not open to persons younger than the legal gaming age in the applicable jurisdiction. Persons younger than this legal age are not allowed to accept gaming-related offers, or win promotions, and we do not knowingly collect information from such persons for gaming-related offers. We reserve the right to verify age at any time for any reason and may decline to provide products, services or access rights to any person who does not have valid age identification.

13. VIDEO SURVEILLANCE.

We use surveillance systems to monitor all gaming areas and other public or sensitive areas of the Eldorado Properties. Video surveillance cameras may be used for security purposes and to protect us, our customers and employees against potential violations of criminal or civil laws.  In addition, cameras may also be used at Eldorado Properties to enhance your customer experience and provide services to you. Surveillance camera output is monitored by our employees and contractors and may be viewed by law enforcement and regulatory authorities.

14. NON-U.S. RESIDENTS.

Unless otherwise specified, the Eldorado Websites and Eldorado Mobile Apps and material provided on or through the Eldorado Websites and Eldorado Mobile Apps are solely intended for users located in the United States and for promoting products, programs, and business operations within the United States. If you do not reside in the United States and you choose to access or use the Eldorado Websites and/or Eldorado Mobile Apps, or visit the Eldorado Properties, and provide your personal information to us, it may be transferred to, processed and maintained on servers or databases located outside of the country or jurisdiction where you are located. If you do not want your information transferred to, processed, or maintained outside of the country or jurisdiction where you are located, you should not use the Eldorado Websites and/or Eldorado Mobile Apps or visit the Eldorado Properties.

15. CHANGES TO OUR PRIVACY POLICY.

Over time, it may be necessary to modify or supplement our Privacy Policy. When we make changes, we will post the changes to the Eldorado Websites and change the effective date at the bottom of the Privacy Policy. We encourage you to visit the Eldorado Websites from time to time to review our Privacy Policy in the event it has changed. Your continued provision of information to us or use of the Eldorado Services following the posting of changes to the Privacy Policy means that you accept the changes and our use of your personal information in accordance with the revised Privacy Policy. If we make any material changes to the Privacy Policy, we will notify you of changes at least thirty (30) days before the effective date of the changes. If you have provided us with your email address, we will also notify you of material changes to this Privacy Policy by sending an email at least thirty (30) days before the effective date of the changes to the email address you most recently provided to us. We encourage you to keep the email address you provide to us current, and to promptly notify us of any changes to your email address, so that you may receive any notices we send to you regarding material changes to this Privacy Policy.
